At Privacy Know How Inc. (also referred to as we, us, our or PKH), we are committed to protecting and respecting your privacy.  We also practice what we preach:

  • We don’t ask you for personal information unless we truly need it.
  • We don’t share your personal information with anyone except to comply with the law, develop our products, or build solutions for you.
  • We only store personal information on our servers if it is required for the operation of one of our services.

This Policy explains when and why we collect personal data, how we use it, the conditions under which we may disclose it to others and how we keep it secure.  We also inform you of your rights and how you can contact us.

How do we collect Personal Data

Data that you provide directly to us

We collect Personal Data that you provide directly to us, such as your first name, last name, job title, company name, e-mail address, postal address, telephone number, country, device-specific information, and log information (as needed and described below) and other personal data that you may communicate to us or that is otherwise collected from you as described below (“Personal Data”). We collect this data when you send us a request or an inquiry, register as a client, fill out a form or survey or submit an on-line meeting request, download information or documents that we publish, request customer support, use our services or otherwise interact or communicate with us in any other way.

Data that we process on behalf of our clients

Our clients may also provide us with Personal Data to fulfill our service obligations to them. In this case we act as a data processor or sub-processor and only process this Personal Data on our clients’ behalf and in accordance with their instructions (as defined in the Master Service Agreement and linked Statement of Works that we contracted with our clients).

Data that we collect from other sources

We may also obtain information from other sources and combine that with the information that we collect as described above. For example, we may collect information about you from third parties, including but not limited to social media platforms, and publicly available sources.

We may automatically collect information about you, including:

  • Information collected by cookies and other tracking technologies: PKH uses only essential cookies to operate this Website.
  • We do not perform analytics or use cookie data to identify or profile our visitors.

 

 

Why do we collect Personal Data

We collect information from you to:

  • Operate, optimize, and maintain our website, including its system administration and security
  • Negotiate and execute contractual documents
  • Carry out our obligations arising from contracts between us and our clients
  • Perform our role as Data Protection Officer pursuant to Article 37-39 of the General Data Protection Regulation
  • Handle inquiries and requests to provide you with information and access to our services or resources
  • Schedule a meeting or perform other administrative duties
  • Seek your views or comments on the services we provide
  • Compile aggregated statistics about the usage of our website and better understand the preferences of our clients and contacts

Legal basis for processing of Personal Data

Our legal basis for processing the Personal Data described above will depend on the Personal Data itself and on the specific context in which we process it. We primarily rely on four legal bases to process your Personal Data:

  1. Your Consent: Where you have given us valid consent to use your Personal Data in certain ways, we will rely on such consent. This includes situations where we will obtain your consent prior to sending you marketing information.
  2. Necessary for the performance of a contract:  We process Personal Data when it is necessary for us to do so to provide our services to our clients, pursuant to their instructions and in accordance with a Master Services Agreement that we have with them.
  3. Legitimate Interest:  In certain cases, we may process your Personal Data where it is necessary in our legitimate interests, such as the Security of our operations, usage statistics and analytics to better understand how to use our website so that we can improve our services.
  1. Legal Obligations: In some case, we may be obliged to process your data to comply with tax and other legal obligations.

 

Who has access to your information

We will not share your Personal Data with any third parties for the purposes of direct marketing or otherwise sell or rent your Personal Data to third parties.

We may share your Personal Data to third parties in the following circumstances or as otherwise described in this Privacy Policy:

  • With your consent or pursuant to your instructions
  • To consultants, subcontractors and other service providers who need access to such information to carry out work on our behalf or to assist us in the provision of our website and other business-related functions such as website analytics
  • As part of a duty to disclose or share your Personal Data in compliance with a legal obligation, for example, by a court order, or for the purposes of prevention of fraud or other crime, or to enforce or apply our Terms and Conditions or to protect the rights, property, or safety of our clients.

 

When we use third party service providers, we only disclose the Personal Data that is necessary to deliver the service and we have a contract in place that requires them to keep your information secure and to keep it for no longer than necessary for the purposes of completing the tasks and providing the services to you on our behalf.

 

Automated decision making

PKH does not make decisions based on automated processing on matters that can have (significant) consequences for people. These are decisions taken by computer programs or systems, without involving a person (for example usage of an AI Program that selects our new hires).

 

Children

PKH services are not directed at children under the age of 16. We do not knowingly solicit or collect personal information from children under the age of 16).

 

Data Retention

We review our retention periods for Personal Data on a regular basis. We will hold your Personal Data in our systems only for as long as is necessary for the relevant activity, or as long as is set out in any relevant contract and its required retention periods, after which time it will be destroyed, unless we are legally required to hold some types of information to fulfil our statutory obligations.

 

Data Security

We have put in place security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your personal data to those employees, contractors and other third parties who have a business need to know. They will only process your personal data per our instructions, and they are subject to a duty of confidentiality. We have also put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

 

Where Personal Data is stored

As part of our services, the information that you provide us with may be transferred to countries outside of the European Economic Area (EEA), which includes all EU countries and non-EU countries Iceland, Liechtenstein and Norway. These countries may not have equivalent data protection laws to the EU or benefit from an adequacy decision by the EU Commission. By submitting your Personal Data, you’re agreeing to this transfer and processing. If we transfer your information outside of the EEA in this way, we will take necessary steps to ensure that appropriate security measures are taken with the aim of ensuring that your privacy rights continue to be protected as outlined in this Policy.

Rights of Individuals (Data Subject Rights)

Depending on your location, you may have certain rights under your data protection laws related to the data we process about you. You may exercise those rights by emailing us or contacting us via mail at the address. These rights are free in most cases, and we will aim to respond to your request within 30 days. Privacy Policy Changes

Privacy Know How reserves the right to review and amend this policy at any time. The latest updated version of the privacy policy will be available on www.privacyknowhow.com and referenced at all data collection sources. Privacy Know How encourages visitors to frequently check this page for any changes to its Privacy Policy. PKH will not send out updates to this policy separately.
